Separation and Divorce
The requirements to obtain a divorce are three-fold:
- There must be an irretrievable breakdown of the marriage;
- There must be no reasonable likelihood that the partners will reconcile;
- There must be at least 12 months of separation immediately before the filing of the divorce application
Financial Agreements
Financial agreements are permitted under the Family Law Act 1975 (Cth) which allows couples to deal with certain financial aspects of the relationship and can be made before or during the marriage or after separation.
De facto partners are similarly able to enter into financial agreements under the Property Law Act 1974 (Qld). These can be made before the commencement of the relationship and following separation
